Breedlove, Dennis & Young (BDY) have successfully completed all permitting and regulatory negotiations for the largest commercial development in the history of Knox County, Tennessee. The joint venture among the City of Knoxville, Knox County, the City of Farragut and Turkey Creek Land Partners, L.L.C., includes a 2.5 mile extension of Parkside Drive, a divided four lane highway from Lovel Road to Campbell Station Road in west Knox County. The road extension allows for the commercial development of 410 acres of property fronting I40/75 by Turkey Creek Land Partners and represents a total build out investment of $400 million.
Environmental permitting involved relocating a first order stream, filling of wetlands, construction erosion and sediment control, stormwater management, FEMA floodway certification, historic and archaeological evaluation and endangered species review. Permitting efforts required approval by the U.S. Army Corp of Engineers, under section 404 of the Clean Water Act (CWA), water quality certification by the Tennessee Department of Environment and Conservation, under section 401 of the CWA and a Section 26a permit from the Tennessee Valley Authority (TVA). Additionally, consultation was required with U.S. Fish & Wildlife Service, Tennessee Wildlife Resources Agency, Tennessee Historical Commission and EPA Region IV. The permitting process was completed in less than twelve months and included two public hearings.
Mitigation for unavoidable loss of stream and wetland habitat includes creation and enhancement of 53 acres of wetlands and 1,400 feet of new stream on site. The 53 acres, know as "Turkey Creek Nature Preserve" has been placed in a perpetual conservation easement and will be managed in the future by Ijams Nature Center. Ijams is a Knoxville, Tennessee based, non-profit foundation providing environmental and natural resources education to the public. This is the largest wetland preservation project of it's type in East Tennessee. Presently, BDY is providing management oversight for all mitigation construction work required by permits as well as providing monitoring and regulatory reports. BDY was retained for the Parkside Drive Project by the Nashville, Tennessee law firm of Waller Lansden Dortch & Davis, PLLC.
